These Terms & Conditions (“Terms”) form a legal agreement between MyDaddy.io (“MyDaddy.io”, “we”, “us”) and the individual or entity that creates an account on the service (“you”, “Customer”). By creating a workspace, enabling an integration, or placing a call through the service, you agree to these Terms. If you disagree, don't use the service.
1. The Service
MyDaddy.io provides (a) a hosted business phone system with browser-based calling, (b) an embeddable AI chat/voice agent for websites, (c) an outbound AI caller agent that works from a CRM list, and (d) integrations with third-party CRMs, helpdesks, phone providers, and automation bridges. The specific features available to you depend on the plan you're on and the integrations you choose to configure.
2. Eligibility & accounts
- You must be at least 18 and able to form a binding contract in your jurisdiction.
- You're responsible for keeping your account credentials safe. If you enable single sign-on (Google, Microsoft, or another identity provider), the security of that upstream identity provider is on you.
- One workspace = one organization. If you operate multiple distinct businesses, create a workspace per business.
- You may invite additional admins and agents into your workspace; you are responsible for their compliance with these Terms.
3. Acceptable use
You agree not to use the service to:
- Violate any applicable law, including but not limited to the U.S. TCPA, CAN-SPAM, caller-ID authentication rules, the FCC's robocall rules, the EU ePrivacy Directive, GDPR, UK GDPR, or your local equivalents.
- Place outbound calls or send SMS to recipients who have not provided the legally-required consent, or who have opted out.
- Impersonate another person or business, spoof caller ID deceptively, or transmit false origination information.
- Harass, threaten, defame, or defraud anyone.
- Transmit malware, run security scans against MyDaddy.io infrastructure (except under a coordinated disclosure we've agreed to), or attempt to bypass rate limits and quotas.
- Resell raw MyDaddy.io capacity as a white-label PBX to third parties without a separate written agreement.
- Use the AI agents to make automated decisions that have legal or similarly significant effects on individuals without appropriate human review.
We may suspend or terminate any workspace that violates this section, with or without notice depending on severity, and without refund for the affected billing period.
4. Your content
You keep ownership of everything you push into the service — call recordings, transcripts, CRM records, the knowledge base the AI agent builds from your site, uploaded greetings, and the configurations you create. You grant MyDaddy.io a limited, worldwide, non-exclusive licence to host, process, transmit, and display that content as strictly required to operate the service you've configured. We don't use your content to train our models or any third-party foundation model on your behalf.
5. Telephony compliance
You are the calling party (and the “sender” for SMS) for every call and message originated through your workspace. That means:
- You are responsible for obtaining any consent required by law before dialling, sending SMS, or initiating an AI caller-agent outreach.
- You are responsible for maintaining internal and per-workspace do-not-call / do-not-text lists, honouring opt-outs, and respecting local time-of-day restrictions.
- Phone numbers routed through MyDaddy.io are provisioned from upstream carriers (Twilio, SignalWire, Telnyx, Bandwidth, or any phone provider you bring); you agree to comply with those carriers' acceptable-use policies in addition to these Terms.
- For emergency services: MyDaddy.io does not route 911 / 112 / 999 or equivalent emergency traffic by default. Do not use this service as your sole means of reaching emergency services.
6. AI agents & disclosures
When you enable an AI agent, you acknowledge that:
- The agent may produce inaccurate or unexpected output. You are responsible for reviewing agent actions that affect real customers (CRM writes, ticket creation, outbound calls).
- Several U.S. states (e.g. California under the Bolstering Online Transparency Act) and some EU member states require disclosure when a natural person is interacting with an AI bot. It is your responsibility to configure agent greetings and scripts to meet those obligations in the jurisdictions where your end users live.
- Transcripts, intents, and summaries may be written to the CRMs / helpdesks you have connected. You control which provider is active per workspace.
7. Third-party services
The service depends on third-party products you choose to connect — telephony carriers, AI providers, CRMs, helpdesks, Zapier, identity providers. Their availability, pricing, and terms are outside our control. Outages, deprecations, or policy changes on their side may affect your MyDaddy.io experience. We'll make reasonable efforts to communicate significant third-party breakage through our status channel.
8. Fees, billing & taxes
- Plans, metered charges (calls, SMS, AI minutes, storage), and any overage pricing are published in your workspace and in the signup flow.
- Fees are billed in the currency shown at signup and are exclusive of taxes. You are responsible for any sales, use, VAT, or similar taxes.
- Paid plans auto-renew until you cancel. Cancel from the workspace billing page; cancellation takes effect at the end of the current billing period.
- We may change fees with 30 days' notice. If you don't accept the change, you may cancel before it takes effect; otherwise continued use is acceptance.
- Late payments may result in service suspension. Persistent non-payment results in workspace termination and data deletion after the retention window in the Privacy Policy.
9. Free tier
If a workspace is on the free tier we may impose usage caps (concurrent calls, monthly minutes, storage, AI inference budget, etc.) and we may change those caps from time to time. Free-tier workspaces that sit idle for more than 180 days may be archived and, after an additional 30 days, deleted.
10. Suspension & termination
- We may suspend or terminate any workspace for material breach (especially section 3 or section 5), for overdue payment, or where required by law.
- You may terminate your workspace at any time from the billing page or by emailing support@mydaddy.io.
- On termination, your right to use the service ends immediately. We'll retain data per the Privacy Policy's retention schedule, then delete it. Invoices for usage up to the termination date remain payable.
11. Confidentiality
Each party agrees to keep the other's non-public information (business, technical, or customer data) confidential and use it only to perform under these Terms. The duty survives termination for three years.
12. Warranties & disclaimers
We make the service available on a commercially reasonable basis and will notify you of planned maintenance when we can. Otherwise the service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted operation. We do not warrant that the AI agents will produce a particular outcome, that every call will complete, or that every integration will remain available.
13. Limitation of liability
To the maximum extent permitted by law, MyDaddy.io's aggregate liability arising out of or related to the service is limited to the fees you paid to MyDaddy.io in the 12 months immediately preceding the event giving rise to the claim. In no event will MyDaddy.io be liable for lost profits, lost revenue, lost data, business interruption, or any indirect, incidental, special, consequential, or punitive damages, even if we've been advised of the possibility. Some jurisdictions don't allow the exclusion of certain warranties or damages — in those jurisdictions our liability is limited to the smallest amount permitted by law.
14. Indemnity
You agree to defend and hold MyDaddy.io harmless from any third-party claim arising out of (a) your use of the service in violation of law or these Terms, (b) content you push through the service, or (c) your violation of section 5 (telephony compliance).
15. Changes to the Terms
We may update these Terms from time to time. Material changes will be announced to workspace admins at least 14 days before taking effect. Continued use after the effective date is acceptance. If you disagree with a material change, you may terminate under section 10.
16. Governing law & disputes
These Terms are governed by the laws of the State of Delaware, USA, excluding its conflict-of-laws rules. Disputes will be resolved first by good-faith negotiation, then by binding individual arbitration in Wilmington, Delaware, under the AAA Commercial Rules. Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction for IP misappropriation.
